These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply in the future.
None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.
When the contract is created
No contract exists between you and us until we notify you that we have accepted your order and delivered the goods.
We are not obliged to accept your order.
We may cancel your order if we cannot supply the goods for any reason.
Description and price of the goods
We make every effort to ensure that prices and descriptions of goods shown on our website are accurate at the time you place your order.
The price of the goods will be as shown on the checkout page of our website when you placed your order. We will charge you this amount.
You must also pay a delivery charge for the goods as indicated on our website at the checkout page.
In the unlikely event that the price shown on the checkout page is wrong, and we discover this before accepting your order, we are not required to sell the goods to you at the price shown. We always try and ensure that the prices of goods shown on our website are accurate, but occasionally genuine errors may occur. If we discover an error in the price of the goods that you have ordered we will let you know as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel your order and you have already paid for the goods, then you will receive a full refund. We may occasionally have to increase the price of goods, even after your order has been accepted by us. If we have to do this, then you may cancel your order.
Delivery
We will deliver the goods that you order to the delivery address you give when you place your order.
Once we accept your order, we will endeavour to deliver the goods within the delivery period that applies to the option you have chosen. If we do not come to the delivery address within the applicable delivery period and you have given us the correct full delivery address then you may apply for a refund of the delivery charge.
If there is no one available to accept the delivery when our courier arrives, the courier will keep the goods for up to two days and you can arrange for a new delivery date. After two days we may treat the order as cancelled by you. In this case we will refund the price of the goods, but we shall be entitled to keep the amount you paid for delivery.
If you give us an incorrect or incomplete delivery address and as a result we try but are not able to make the delivery, we may treat the order as cancelled by you. In this case we will refund the price of the goods, but we shall be entitled to keep the amount you paid for delivery.
If some of the goods you ordered are not available we may deliver part of your order. We will deliver the rest of the order as soon as possible afterwards.
Your right of cancellation under the Consumer Contracts Regulations
You may cancel the contract under the Consumer Contracts Regulations by notifying us no later than 19 working days after we deliver the goods that you are cancelling the contract. You may not cancel your contract with us under the Consumer Contracts Regulations where any audio or video recordings or computer software has been unsealed by you.
If you cancel the contract under the Consumer Contracts Regulations, you must take reasonable care of the goods from the time you receive them until you return them to us.
If you cancel the contract under the Consumer Contracts Regulations you must return the goods to us at your own expense.
If you cancel the contract under the Consumer Contracts Regulations and do not return the goods as required, we may charge you our direct costs of recovering the goods.
Faulty goods
In these terms and conditions, faulty goods means any goods we supply to you that do not conform to the contract. Faulty goods does not include any goods that are faulty due to fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than in accordance with their intended use, failure to follow the manufacturer's or our instructions, or any alteration or repair carried out without the prior approval of us or the manufacturer.
You should notify us as soon as possible if you discover that any goods are faulty goods.
If you return goods because you think they are faulty goods, we may charge you the cost of all transport and our actual costs and expenses in the event that the goods are not in fact faulty goods.
Returning goods – general
When you return goods to us for any reason (for example because you have cancelled the contract under the Consumer Contracts Regulations or because you think they are defective goods):
you must ensure that they are:
Items must be unused and in their original packaging in a saleable condition.
Items must be properly and securely packaged and labelled with our address;
you are always responsible for any damage in transit that is due to incorrect or inadequate packaging by you; and
you are responsible for any damage or loss in transit where you arrange the transport (rather than using our courier).
Force majeure
We shall not be liable for any failure to perform, or delay in performing, any of our obligations under the contract if and to the extent that the failure or delay is caused by circumstances beyond our control.

If you usually reside outside the European Region, where we refer to “TikTok”, “we” or “us” in this Privacy Policy, we mean TikTok Pte. Ltd, a Singapore company (“TikTok Singapore”).

We are committed to protecting and respecting your privacy. This TikTok Shop Privacy Policy sets out the basis on which we process any personal data we collect from you, or that you provide to us, if you use TikTok Shop as a Merchant, Creator or User, or if you visit or use related TikTok Shop applications or websites that are available from time to time and that link to or reference this TikTok Shop Privacy Policy. In particular, this TikTok Shop Privacy Policy applies where:

  • Sellers (“Merchants”) promote and sell (“Offer”) goods (“Products”) to users of TikTok (“Users”) via the TikTok Shop;
  • TikTok creators (“Creators”) promote Products Offered by Merchants via the TikTok Shop; and
  • Users buy Products from Merchants via the TikTok Shop.

This TikTok Shop Privacy Policy incorporates and supplements the TikTok Privacy Policy. This means that, for example, personal data we collect via the TikTok Shop will also be used for the purposes described in the TikTok Privacy Policy and vice versa. The TikTok Privacy Policy also includes important information on your rights and how we store and protect your personal data. Any capitalized terms not defined in this TikTok Shop Privacy Policy have the meaning given to them in the TikTok Privacy Policy.

SUMMARY

What information do we collect about you via the TikTok Shop?

If you are a User, we collect information needed to facilitate your purchase, delivery of Products from Merchants and user support regarding your order. For example, your name and address, your card payment details, your purchase history, and any additional information we process when you contact us or the Merchant for support via our Platform or contact us by telephone.

If you are a Creator, we collect information regarding the Products you have chosen to promote, and related information regarding purchases and commission.

If you are a Merchant, we collect information about you and your representatives necessary for you to register with and make use of the TikTok Shop, as well as any additional information we process when you chat with us, a Creator or a User via our Platform or with us by telephone or email.

Where you are using a related TikTok Shop application or website, we also collect other information that you choose to provide to us, such as your contact information, and technical information that we automatically collect.

How will we use information collected about you via the TikTok Shop?

If you are a User, we use your information to perform our contract with you, including to allow you to purchase and receive Products you have ordered from Merchants.

If you are a Creator, we use your information to perform our contract with you and for our legitimate interests in helping Merchants work with you to promote their Products based on your profile.

If you are a Merchant, we use your information to perform our contract with you and for our legitimate interests for the purposes of our due diligence, identity verification, fraud prevention and operation of the TikTok Shop.

If you are a Merchant, Creator or User, we will process your personal data for our legitimate interests to optimize and improve the features and functionality of the TikTok Shop.

Where you are using a related TikTok Shop application or website, we will use your information to provide that service to you, and to respond to you with the information you have requested.

Who do we share your information with if you use the TikTok Shop?

If you are a User, we will share your information with the Merchant you have ordered a Product from, as well as third party logistics providers to deliver your ordered Products, and payment providers to facilitate your payment of the Product. 

If you are a Creator, we may share your information with Merchants for the purposes of allowing Merchants to select Creators to promote their Products, and with payment providers to facilitate payment of commission. We may also share your performance data with the agency that represents or manages you.

If you are a Merchant, we may share your information with third party logistics providers and payment providers necessary to facilitate orders from Users.

  1. The types of personal data we use

If you are a User, we collect the following information:

  • Your name, address, post code, telephone number and email address;
  • Payment details, such as your credit or debit card information, payment authentication code and billing address;
  • Purchase and transaction history in relation to Products that you purchase from Merchants via the TikTok Shop;
  • Feedback or comments that you provide in relation to a Product or order;
  • Logistics information in relation to delivery of your Product by a third-party logistics provider on behalf of the Merchant;
  • Products that you place in your shopping cart;
  • Technical information such as your IP address, device ID, time zone and language settings; and
  • Information that we process when you contact us or the Merchant for support through the chat function provided by us via our Platform or by telephone, such as images of a Product or order, enquiries about a Product or order, or your evaluation of our support service.

If you are a Creator, we collect the following information:

  • Your name;
  • Information regarding the Products you have chosen to promote, including the title, price, quantity, stock status and commission in relation to such Products;
  • Information regarding sales generated and purchase and transaction history and related video and live-stream metrics;
  • Bank account information;
  • Technical information such as your IP address, device ID, time zone and language settings; and
  • Contact information (for example, email/phone number/WhatsApp account name) that you choose to provide through the E-Commerce Creator Center.

If you are a Merchant, we collect the following information:

  • The name of your shop, shop logo, your name, whether you are a personal seller, the country your shop is located in, your phone number, your email address and category of Product (for example, clothes, toys etc.) and related business information;
  • If you are a company, we collect contact details (such as name and phone number) of your legal representative(s) or contact person and identification documents (such as passport or national ID card);
  • If you are a personal seller, your identification information such as a copy or photo of your government-issued ID card or passport and your bank account information;
  • Purchase and transaction history information and information on refunds and complaints;
  • Logistics information regarding shipment and delivery of Products, including by third party logistics providers;
  • Technical information such as your IP address, device ID, time zone and language settings; and
  • Information that we process when you contact us or when you interact with a User regarding support through the chat function provided by us via the Platform.

If you are visiting or using a related TikTok Shop application or website, we also collect other information that you choose to provide to us. This may include your contact information, such as your name, email address and phone number. We will also automatically collect technical information such as your IP address, device ID and browser information.

  1. How do we use your personal data

If you are a User, we use your information to perform our contract with you, where you order Products Offered by Merchants via the TikTok Shop. This includes sharing your additional information with Merchants and third-party payment providers for the purposes of fulfilling your order, and sharing your information with third party logistics providers for the purposes of delivery of your Product(s) on behalf of the Merchant. We also use information that you provide us and/or we collect from you when you contact us via our Platform or by telephone for support, for the purposes of providing you with user support regarding your order, which may include responding to or processing your queries, feedback, claims or disputes. 

If you are a Creator, we use your information to perform our contract with you, where Users have ordered Products and you are entitled to commission.

We will also use the content you upload, and related information such as the number of likes and responses you receive, and information about your followers for our legitimate interests to allow Merchants to identify you based on your profile and to help Merchants decide whether they would like to work with you for the promotion of their Products. We will also use this information, and information regarding sales attributed to you, for our legitimate interests to understand your performance with a view to exploring further collaboration with you.

If you are a Merchant, we use your information for our legitimate interests to verify your identity, to enable you to manage your store (including to open or close your store), to contact you with a view to improve and develop your business on the TikTok Shop, for risk management purposes and to prevent and respond to abuse, fraud, illegal activity and other potentially harmful content. We also use your information to perform our contract with you in relation to the TikTok Shop.

If you are a Merchant or User, we will process your messages sent or received between Merchants and Users to provide the TikTok Shop messaging functionality to perform our contract with you. We also process messages sent or received between Merchants and Users to investigate and resolve complaints or disputes between Merchants or Users. We process such personal data for the purposes of our legitimate interests in investigating and resolving such complaints or disputes between Merchants and Users.

If you are a Merchant, Creator or User, we will process your personal data for our legitimate interests to optimize and improve the features and functionality of the TikTok Shop and for risk management purposes and to prevent and respond to abuse, fraud, illegal activity and other potentially harmful content.

If you are a Merchant or a third party that uses the TikTok Shop Open Platform, we collect, use and store the personal data listed above in order to provide and administer the TikTok Shop Open Platform.

If you are visiting or using a related TikTok Shop application or website, we will also use your information to provide that service to you, to interact with you including by responding to you with the information you have requested, providing customer support or sending you marketing messages in accordance with your preferences.

  1. How we share your personal data

If you are a User, we share your information with Merchants and third-party logistics providers to facilitate your order and delivery of a Product from Merchants. To process your payment, we also share your information with payment providers including, in particular, Stripe, a third-party payment processor. You can access Stripe’s Privacy Policy via the following link: https://stripe.com/en-ie/privacy.

We may also share your information with our affiliates to provide user support to you, as well as with Merchants to the extent necessary to allow the Merchant to initiate communications with you to provide you with user support under limited circumstances regarding your order, including the necessary steps to be taken in a situation when the Product is out of stock.

If you are a Creator, we may share certain information about you with Merchants for the purposes of allowing Merchants to select Creators for the promotion of their Products, and with payment providers to facilitate payment of commission. We may also share your performance data with the agency that represents or manages you so that the agency can fulfil its contractual obligations with you.

If you are a User or Creator, note that Merchants and logistics providers may be located outside of the European Region, or the country you usually reside in.

If you are a Merchant, we may share your information with payment providers and logistics providers to the extent necessary to facilitate orders of Products from Users.
